How about the consumers that bought into the never clogs,never looses suction [false advertising B.S.]. Can they get  their money back? after being lied to by Dyson,and maybe on purpose...........
 
These con men have made it very difficult for the legit dealers that really know the truth...........

Excellent question Pro.  Yes, they can in a class action lawsuit against dyson and the dyson retailers where they purchased their dysons.  We're not talking about "sales puffing" now.  The infamous dyson claim to shame is a blatant untruth used to sell a product at a price way higher than warranted.  Along with the corrollary false claim that dysons cost "zero" dollars to use and operate, dyson knowingly perpetrated untrue product claims to foster its own profits for over 5 years at the expense of unknowing consumers.
 
The ASA ruling against dyson and dyson's own actions in scrubbing it's Web site of the infamous claim to shame: "Never clogs; never loses suction" almost  guarantees IMHO an out of court settlement by dyson with all the litigants.   Dyson has been very hush hush about the ASA ruling and doesn't want the negative press and publicity.  Which you know will follow.  
 
Ironic that the man and company who started and expanded his dyson business with funds from law suits against 2 other vacuum makers, now is on the receiving end and will have to pay.

A moron can screw up anything.  The person who clogs a Dyson would likely bend a pry bar.
 
Anyone buying a Eureka boss should also be able to get a refund because it does not clean better than Dyson as advertised.  Neither does the Hoover fusion.
 
Looks like BS splatters.

The legal difference is that dysons cost their buyers $500 plus and Eureka Boss and HOOVER Fusion's cost $100.  You always go after the "moron" with the deepest pockets in a class action lawsuit.  That would be dyson and its retailers in this case [if you don't know].

Thanks for your thoughts Carmine.  I was taught that honesty should apply to all rich or poor.  Seems that you think a lie is alright if you are after the more successful.  Perhaps that explains your opinions since you are a pup trying to go against the big dogs.

Thanks for the compliment.  That makes 3 today and the day ain't over yet.  First the hostess at the Casino today called me Honey, then the waitress at lunch said I was in great shape as she squeezed my arm muscle and eyed balled (she was younger than my daughter) my tan legs and now you call me a 'pup.'   I'm on a roll.    Wink
 
If all were honest like you and I there would be no need for the ASA and lawyers, judges, and prisons.  
 
Since we are being honest, in your expert opinion, what do you think will happen to dyson sales and prices now that dyson is precluded from using its mantra:  NEVER loses suction, NEVER clogs.  (NEVER say NEVER).

First,  I did not compliment you.  I doubt that the omission of never loses suction and never clogs will have any negative impact on Dyson sales.  Too much word on the street that Dyson is #1 for cleaning. All the others are imitating and tryhing to catch Dyson.   I would like to see Dyson prices drop, however a manufacturer does not drop prices when they are at the peak.  Sometimes that is a mistake, sometimes not.

Word on the street?  Really?  Main street or Wall Street?
 
Talking about word on the street, you may have heard that the Dow soared almost 300 points today.  Why?  Well, in part due to retail sales reports for June.  And quess who beat the street?  Wal*Mart.  That's right.  Street was predicting 1 percent increase in same store sales for June for Wal*Mart, in part because of the poor showings by SEARS and BEST BUY.  Instead, Wal*Mart reported an increase of 2.4 percent and its stock went up over a buck to $48 plus a share.  
 
I thought about you today and your opinions on price and quality.  Why?  It seems a $2.00 bottle of Charles Shaw Chardonay [in the vernacular called 2 BUCK Chuck] from CA beat out $18, $55, and $125 bottles of Chardonay that were part of over 55 wine brands tested by a group of expert wine taste testers.  
 
The 2 BUCK Chuck wine is sold exclusively by an upscale grocery store.  When the store owner was asked why he sells such an inexpensive wine brand to his upscale clientele, he replied because his customers like it, buy it and it's worth the price.  Sounds like the ingredients for quality.  
 
On the dyson sales, I respectively disagree with you my friend.  But I know where you are coming from.  As I said, where you stand depends oftentimes on where you sit.  
 
On the contrary, I believe the 5 year old dyson "lie" will hurt dyson's brand name with past and future buyers.  And dyson's tarnished brand name now will have an adverse impact on dyson in the future.  You know that better than me.  It's hard to build and keep a trusted brand name in the USA.  Like ORECK and HOOVER for example.  Both were instrumental in providing evidence to the ASA which was detrimental to dyson.  And once your brand name is tarnished, it's almost impossible to restore.  Like putting a drop of food coloring into a pristine glass of clear crystal water.  Once the coloring contaminates the clear water, you can never get it out.
 
Dyson is taking the possibility of a class action suit by past buyers very serious.  Why?  For 2 reasons.  If the public news about the lawsuit doesn't bankrupt dyson, the payout settlement surely will.  You don't knowingly lie about a $500 plus retail product and get off with a handslap from the ASA.   People are very unforgiving when they get "duped" and spend their money based on false and misleading product claims.  I suspect at least one, maybe more of the over 30 complainants against dyson is (are) lawyers.  And have started the legal proceedings in motion.
 
Kudos to Jimmy the Pro who appended the dyson claim to shame as follows so as to be truthful:  "Never clogs....Never loses suction" and Jimmy added.......for a little while.  
 
Looks like Kenneth J. will get his justice after all.

KOHL's looks like the winner for vacuum sales this week.  Check Web Site and store nearest to you for details.  
 
Kudos to KOHL's for dropping the false dyson claims "NEVER CLOGS, NEVER LOSES SUCTION" in its dyson vacuum ads.  The action is mandated by the Advertising Standards Agency in a June 2007 ruling against dyson after 3 dozen complaintants filed an action against dyson with the agency.
 
Several no shows no goes including BEST BUY and TARGET.  
 
Circuit City has the HOOVER Elite Rewind bagless upright for $89 and the BISSELL HEALTHY HOME for $249.
 
BIG LOTS enters the sales venue this week with the Eureka Uno bagless upright for $60 with a caveat:  Refurbs and repacks.  However these come with the Manufacturer's warranty of one year just like the new.
 
ORECK passed on the Sunday ads but hit the weeklies with the XL Classic for $299 and a bunch of good stuff to boot with purchase.
 
Kmart's in too with the weekly usual sales brands and models: BISSELL, Kenmore and Dirt Devil.  BUT with a newbie from DD: the Extreme Quick Vac stick/lightweigh upright for $44.  Emulates the HOOVER Nanolite.

A complaint including Hoover/Tandy in the UK to an UK agency can not mandate actions in the US by an US company.  Anyone can read the actual rulling. The ruling backs the science behind the dyson claim and makes it clear that dyson did not intend to mislead but states 1 specific UK TV commercial was not worded clearly enough and might unintentionally leave some viewers with incorrect assumptions.  This has no bearing in the US at all.  It is apples and oranges, for example many ad's in foreign countries would be fined and banned here as indecent but we do not get to mandate rules abroad.  In some european countries there are strict prohibitions against any comparitive advertising of any kind, no matter how truthful, which would make 90% of all advertising here illegal and yet ads ruled illegal in belgium are the norm here  and like this ruling have nothing to do with what can be "mandated" here.
