Using this weekend's NEWSPAPER dyson adverstisings, none of the retailers use the words: Never loses suction.  
 
LNT:  (Giving 20 percent off in violation of dyson MAP). "Root Cyclone technology is extremely effective at picking up tough materials."  (DC14 Animal)
 
HECHT's:  (Giving 15 percent off in violation of dyson MAP).  "Patented root cyclone technology to maintain suction."  (DC07 All Floors)  
 
Kohl's:  No verbage except "All Floors."  (DC07 All Floors).
 
BEST BUY: No verbage except twists and turns. (DC15)
 
4 major retailers with 3 different dyson vacuum models advertised in the SUNDAY NEWSPAPERs and the trade mark dyson verbage is conspicuously absent: NEVER LOSES SUCTION does not appear atol.  
 
I wonder why??
 
Could it be that those same industry approved organizations like ASTM, CRI, Consumer Reports and Good Housekeeping (loathed by a certain bagless brand and its fans) have combined forces to preempt dyson from making the "false" claims in NEWSPAPER printed advertising?  
 
These industry approved, standard making organizations will do that from time to time if necessary:  They will "police" makers' claims and pressure them to eliminate/revise false claims.  I wonder if that's what happened?
 
Or could it be that one or more vacuum makers have "sued" or threatened to sue if the false claims are not omitted?  That's a possibility too.
 
In any event, and whatever the reason, the dyson trade mark words are conspicuously missing from advertised NEWSPRINT.

Hello Old-Timer:
 
The two things about the Trilobite that don't fit in the mix of the Electrolux AB Sweden product line:  The unusual name (vice the Oxygen, Aptitude, and Pronto) AND the high price $1800, almost 4 times greater than the vacuums' prices.  EUREKA never was an innovator of great reknown in the vacuum industry.  It's forte is copy and imitation (or buying the rights) and doing it on the cheap vice the competitors.

The claims read:  "Superior suction power that lasts."
 
"Patented D2" technology for sustained suction and excellent performance at the nozzle.  Features easy-empty filterless dirt cup, HEPA filter and rotating power brush to clean upholstery and stairs.  $169.99  
 
Just enough to wet the buyers' appetite.  The 4 year product warranty is the icing on the cake that clinches the deal in the store.
 
Dyson DC14 Animal for $549.99.  Conspicuously absent: THe trade mark dyson mantra: NEVER LOSES SUCTION.
 
As part of the "Spring" advertising campaign expect to see the HOOVER FUSION at Wal-Mart advertised for $128.88 with the claim: NO LOSS OF SUCTION.

Carmine  So what has Aerus done in the pass year to improve there product ? Can you tell us about there motors they put into there vacuums today. Joe Urso  has done what for Aerus ? Carmine  you have the time to look into this also look into Joe Urso background. The trade name Electrolux was sold to Sweden Electrolux  by Joe  in the first years with Electrolux  Joe is a very smart person  he has Aerus today where he wants it to be this was Joe plan from the start . It is all about profit for Joe he has done great for Joe Urso .

As a business man, I have to respect those qualities in a CEO whether I personally like him or not.  Without those qualities in the vacuum industry today, a company won't survive.

Carmine. There is a line to draw when you talk profit . The mafia is all in it for profit also. I was in management for years and to stay in management you show a profit but there is a line I could and would not cross and I said so long Electrolux and Joe Urso.

I would not put any legal stake in this perhaps only an evolution in marketing strategy.  Many of Dyson's advertisements are directly used to steer consumers to the Dyson official website where quotes like the below are ongoing and newly added.
"FACT: ONLY DYSON MAINTAINS CONSTANT SUCTION.
Other vacuums rely on bags or filters to trap the dirt so they clog and lose suction.
Dyson technology uses centrifugal forces to separate the dirt out of the airflow. There's nothing to clog, so a Dyson vacuum cleaner doesn't lose its suction - ever."
 
I fail to see how this can be construed as Dyson no longer making these claims due to litigation concerns.  The above seems to be a clear and forceful claim and being on the official Dyson website seems like it would open up more litigation concerns than a newsprint ad.

That's why and what the present litigation in Federal court will determine. (IMHO)
 
In the meantime, third party retailers are eliminating their exposure to a possible lawsuit by taking out the claims.

A huge assumption, that seems a lot like wishful thinking to argue a preconcieved prejudice and not based on documented fact.

I believe my depiction of the facts with respect to the vacuums' claims and makers' litigation accurately reflects the reality of the situation.
