The first thing a people in over their financial heads should know, is that filing personal bankruptcy has been made more difficult due to passage of the Bankruptcy Abuse Prevention and Consumer Protection Act in 2005. The law is seen by consumer advocates as a boon to the credit card industry which may receive billions from mandated repayment plans and generally goes into effect in October 2005.
But the economy can sometimes mitigate against even the most frugal. With a job loss and a medical crises, some of us will be forced into this difficult declaration.
